When a US VPS is a good fit

A US data centre is a practical choice when most of your visitors, customers or players are in North America. Keeping the server closer to them can reduce network round-trip time, which matters for interactive work: API calls, remote administration, live dashboards, multiplayer games and bots that respond to player actions. A US-focused small business site can benefit too, particularly when each page request triggers several calls to the server.

For a SaaS backend serving US customers, a US location can make sense for performance and operations. It does not, by itself, decide whether your data handling meets legal requirements. If most of your users are in Europe, a European VPS or a delivery setup with a CDN is usually a better starting point for latency. Choose the location around the people using the service, not just the company address.

Check latency from your actual users

Round-trip time (RTT) measures how long a packet takes to travel to a destination and back. It is not a guaranteed figure for a particular VPS: routing, peering, congestion and the time of measurement all affect the result. Third-party network measurements give useful context. One set of measurements puts New York to Frankfurt at about 74 ms, Amsterdam to New York at about 68 ms, Los Angeles to New York at about 59 ms, and Los Angeles to Frankfurt at about 137 ms. These are example city-pair results, not promises for any plan in the table.

Measure from the places your users actually connect. If you are choosing a game or bot server, test from several player locations at busy times and compare packet loss as well as RTT. A measurement service such as WonderNetwork averages 30 pings per city pair; its current results can help you compare routes, but your own tests are more useful for a specific application.

  • For a US audience, test from the regions where you expect most sessions.
  • For a mixed US and European audience, compare both groups before committing to one location.
  • For an API, test the complete request path, including any database or third-party service calls.

The US filter narrows our table to VPS plans with servers in the United States. It does not identify a specific city, data-centre operator or network for each plan, so check the individual plan details and ask the provider where the server will be placed.

GDPR: a US server means checking transfer rules

If your service sends EU personal data to a US VPS, GDPR Article 44 requires the transfer to meet the conditions in Chapter V. Those rules also cover onward transfers, so consider where the provider’s subprocessors may handle data, not only the server’s physical location. A US VPS is not automatically compliant or non-compliant; the answer depends on the data, processing arrangement, provider and transfer basis.

Chapter V provides routes including an adequacy decision, appropriate safeguards and derogations for specific situations. The EU-US Data Privacy Framework is an adequacy route for transfers to US companies that participate in the framework. Appropriate safeguards are another route; standard contractual clauses may be relevant, but their suitability depends on your circumstances and the associated assessment.

Before storing EU customer data on a US server, identify the data you process, the provider’s role and the transfer mechanism you intend to rely on. Review the provider’s terms, security measures and subprocessor information, then have counsel assess the arrangement. Do not assume that choosing a country in the hosting control panel settles the GDPR question.

What the Data Privacy Framework changes

The European Commission adopted the EU-US Data Privacy Framework adequacy decision on 10 July 2023. It permits transfers to US companies that participate in the framework. Certification matters: the existence of the framework does not mean every US provider is covered. Check the specific company’s current status in the framework directory and confirm that the relevant services and data are within scope.

The framework remains in force, but its legal position is being challenged. The General Court dismissed Philippe Latombe’s challenge in September 2025, and he appealed to the Court of Justice on 31 October 2025. That appeal is pending as Case C-703/25 P. The ongoing case is a reason to keep your transfer assessment current, not a reason to treat the framework as already invalidated. If your organisation relies on it, ask counsel how to plan for a change in the legal position.

The CLOUD Act: location is not the whole story

The CLOUD Act added 18 U.S.C. 2713 to the Stored Communications Act. In general, it requires US-based providers to produce data in their possession, custody or control, wherever that data is stored. That means a US provider’s European data centre does not automatically put data beyond US legal reach. The provider’s jurisdiction and its control over the information matter alongside server location.

How “control” applies to particular data and arrangements can be a legal question. Client-side encryption, where only you hold the keys, may limit what a provider can access, but it is a risk-reduction measure, not a guarantee against legal demands or a substitute for legal advice. If your organisation must keep data outside US legal reach, do not treat a US VPS as suitable; assess the provider’s ownership, jurisdiction and control even when the server is in Europe.

Choose the plan around the workload and the data

Once the location fits, match the resources to your application. Memory affects how many processes, game instances or concurrent requests you can run. NVMe storage can suit workloads with frequent disk access, while disk capacity should account for backups, logs and updates as well as the application itself. Check whether root access is required for your software and whether you want to manage the operating system yourself or pay for a managed service.

Read traffic limits carefully. A plan labelled “unlimited” can still have terms governing acceptable use or network consumption. If you need a control panel, confirm that the plan includes the one you want; the US filter lets you narrow results by memory, disk, traffic, management, panel, root access and NVMe. Across all 116 plans from 17 providers in our full VPS comparison, prices start at $2.09 and average $69.09 per month. Those figures describe the full comparison, not only the US-filtered plans. Prices were last synced on 31 October 2026.

Before ordering, ask the provider for clear answers to these points:

  • Which US location will host the VPS, and can the location be changed later?
  • Does the provider participate in the Data Privacy Framework, and does that certification cover the service you plan to use?
  • Which subprocessors may access or process your data, and in which countries?
  • What do the contract and security documentation say about government requests, access controls, encryption and data deletion?
  • Can you keep encryption keys under your control, and what support or management is included?

Keep a record of the provider’s answers and review them when your data, workload or legal basis changes. For a transfer of EU personal data, or a requirement to limit US legal exposure, confirm your position with counsel before you migrate.

Frequently asked questions

Is a US VPS allowed under GDPR?

A US VPS is not automatically allowed or prohibited under GDPR. If EU personal data is transferred to it, the transfer must meet the conditions in Chapter V, and onward transfers must also be considered. The appropriate basis depends on the provider, processing and data involved. Review the provider’s terms and transfer arrangements with counsel before placing EU personal data there.

Does the EU-US Data Privacy Framework still apply in 2026?

Yes. The European Commission’s adequacy decision remains in force, and it covers transfers to participating US companies. Its legal position is under appeal at the Court of Justice, so it has not been invalidated, but the case is still pending. Check that the specific provider participates and seek legal advice if your transfer arrangements rely on the framework.

Can US authorities access my data if it sits on a US server?

The CLOUD Act requires US-based providers to produce data in their possession, custody or control, wherever it is stored. A US server therefore does not remove the possibility of a legal demand. Whether a provider has control over particular data can depend on the arrangement. Client-held encryption keys may limit provider access, but do not guarantee protection from legal process.

Is a US VPS faster for visitors in the United States?

It can be, especially when your visitors and server are in nearby parts of North America. Actual RTT depends on the route, provider network, congestion and user location, so do not rely on a universal latency promise. Test from the regions where your users connect, ideally at different times, and include the full application path if it calls other services.

Which US cities do the plans in the Hostcomplex filter use?

The US filter shows VPS plans with servers in the United States, but it does not name a city, data-centre operator or network for every plan. Check the individual plan details or ask the provider for the intended location before ordering. If precise placement matters for players or customers, test latency to the confirmed location.

Can I put a CDN in front of a US VPS to serve European visitors?

A CDN can cache and deliver eligible content from locations closer to European visitors, which may improve delivery of static files and some pages. It does not move your origin server or automatically resolve latency for dynamic requests, API calls or uncached data. It also does not remove GDPR transfer obligations if personal data is sent to the US origin or other destinations.
